Terms of service

The agreement between you and Ragu And Lika IP Private Limited when you use this application.

01 Who you are contracting with

This application is operated by Ragu And Lika IP Private Limited, a company registered in India, at Y II E 120/2, Triveni Puram, Jhunsi, Prayagraj, Uttar Pradesh 211019, GSTIN 09AANCR3540G1Z7. In these terms "we" and "us" mean that company, and "you" means the person or firm using the application. Creating an account means you accept these terms. If you are accepting on behalf of a firm, you confirm you are entitled to bind it.

02 What the service does, and what it does not do

The service records events on your Indian trade mark applications and registrations, calculates the periods that follow from those events under the Trade Marks Act 1999, the Trade Marks Rules 2017 and the decisions of the courts, shows you the source of every date, and reminds you before those dates arrive.

It is a docketing and reminder aid. It is not legal advice, it does not create a lawyer–client or agent relationship, and it does not act for you at the Registry. It does not file anything, does not monitor the Registry continuously, and cannot know about anything you have not recorded in it. Every date it shows is calculated from the information available to it, which may be incomplete, out of date or wrong. You must verify every deadline independently against the official record and with a qualified professional before acting, or before deciding not to act.

Where the law is genuinely unsettled — and on trade mark evidence periods it is, because the High Courts do not read rules 45 to 47 the same way — the application says so, names the courts on each side, and recommends professional verification. It does not choose for you.

03 What it costs

Subscription rates, what each plan includes and how the metered elements are counted are set out on the pricing page, which forms part of these terms. All rates are exclusive of GST unless stated otherwise; GST is charged at the rate in force, currently 18%, and shown separately on your invoice.

If you have supplied a valid GSTIN, your invoice carries it and you may claim input tax credit in the ordinary way. If you have not, we cannot add it later to an invoice already issued.

04 The amount changes when your portfolio changes

Plans include an allowance of trademarks, users and storage. Where you go beyond the allowance, the extra is charged at the rates on the pricing page and appears on your next invoice. The amount is therefore not fixed: it follows what you actually hold in the docket on the day the invoice is raised. You can see the current count at any time in Plan and payments.

Where a change would increase what you pay by more than a nominal amount, we give you at least twenty-four hours' notice before the debit, so you can remove marks or cancel first.

05 Automatic payment, and what you are authorising

Subscriptions are collected by standing instruction through our payment gateway. By subscribing you authorise recurring debits of the subscription amount, as it varies under clause 04, until you cancel. We never see or store your card details; the gateway handles them.

06 If a payment fails

A failed debit does not close your account. You keep full access for fourteen days while we retry and while you fix the payment method. After that the account becomes read-only: you can still see, search and export everything, but you cannot add new marks or record new events. Nothing is deleted.

07 Your account and your data

Your marks, clients, documents and notes are yours. We do not claim any right in them, we do not sell them, and we do not use them to train models. We process them to run the service for you and for nothing else.

You are responsible for who you invite into your workspace and for what they can do there, and for keeping your own sign-in secure. If you use a password, use one you use nowhere else. Tell us at once if you think an account has been reached by someone who should not have it.

08 What you must not do

• Store anything unlawful, or anything you have no right to store.
• Attempt to reach another organisation's data, or to test the boundary between workspaces. If you believe you have found a way through, tell us instead — we will thank you properly.
• Resell or sublicense access, or use it as a back end for another product, without a written agreement.
• Scrape the application, or drive it with automated tools, other than through an interface we publish for the purpose.
• Use it to attempt to bypass any access control, CAPTCHA or authentication on the Registry's own systems. The application never does this, and neither may you through it.

09 Availability

We aim to keep the service available and we do not promise that it always will be. Maintenance, a hosting failure or a dependency going down can interrupt it. Where an interruption is planned we will tell you first. An interruption does not extend a statutory period, and it is your responsibility — not this application's — to meet a deadline that falls during one.

10 Limitation of liability

Nothing here limits liability for fraud, or for anything that cannot lawfully be limited. Subject to that, and to the fullest extent Indian law permits:

• we are not liable for a missed deadline, a lapsed or removed registration, an abandoned application, an adverse decision, or any loss of rights, profit, goodwill or opportunity arising from your use of or reliance on the service;
• our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.

This is the natural consequence of clause 02. The application is a reminder; the professional judgement, and the responsibility for the file, remain yours.

11 Changing these terms and the price

We may change these terms, and we may change the price. For anything material — including any increase — we give you at least thirty days' notice by email to the address on your account, and the change takes effect on your next billing date after that period. If you do not accept it, cancel before then; you will not be charged the new amount.

12 Ending the agreement

You can cancel at any time from Plan and payments, with immediate effect on future charges. What happens to your data, and when money comes back, is set out in the cancellation and refunds policy.

We may suspend or end an account for non-payment after the period in clause 06, or for a serious breach of clause 08. Except where the law requires otherwise we will give you notice and a reasonable chance to export your data first.

13 Law and disputes

These terms are governed by the law of India. The courts at Prayagraj, Uttar Pradesh have exclusive jurisdiction. Before starting proceedings, please raise the matter with our grievance officer — see contact us — because most things are a misunderstanding about a date and are settled in a day.
